Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Gifmailer (the "Service"), operated by Gifmailer ("we", "us"), available at gifmailer.com. By creating an account or using the Service, you agree to these Terms.

2. The Service

Gifmailer lets you generate animated GIFs from photos, prompts, or short video references using third-party AI models, embed them into email templates, and create Gmail drafts via Google OAuth.

3. Accounts

You must be at least 18 years old to use the Service. You are responsible for the security of your account credentials and for any activity that occurs under your account.

4. Plans, credits & billing

The Service is offered on a subscription basis with monthly credit allowances, plus optional credit top-ups. Subscriptions renew automatically until cancelled. Prices are listed on our Pricing page. Payments are processed by our payment providers (e.g. Paddle), who act as merchant of record where applicable.

5. Acceptable use

You agree not to use the Service to:

• Generate content that is illegal, defamatory, harassing, or infringes intellectual property.
• Generate sexual content involving minors, non-consensual intimate imagery, or deepfakes of real people without consent.
• Send unsolicited bulk email (spam) or violate anti-spam laws (CAN-SPAM, CASL, GDPR, etc.).
• Attempt to reverse-engineer, resell, or abuse the Service or its underlying providers.

6. Your content

You retain ownership of the photos, prompts, and outputs you create. You grant us a limited license to host, process, and display this content solely to operate the Service. We do not use your content to train AI models.

7. Third-party services

The Service relies on third-party providers including Google (Gmail), and AI model providers such as the Lovable AI Gateway, Black Forest Labs (Flux), Replicate, and Google Gemini. Your use of those features is also subject to their respective terms.

8. Termination

You may cancel your subscription at any time from your account settings. We may suspend or terminate accounts that violate these Terms.

9. Disclaimers & liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our aggregate liability is limited to the amount you paid us in the 12 months before the claim.

10. Changes

We may update these Terms from time to time. Material changes will be announced via email or in-app notice. Continued use of the Service after changes constitutes acceptance.
